Transport Canada Proposes Vessel Operation Restriction Regulations |

Transport Canada has issued a draft set of proposed regulations that will govern the operation of vessels, both commercial and recreational, in Canadian waterways. The proposed regulations conform to the Canada Shipping Act 2001, which went into effect on July 1.
The proposed regulations would govern access by vessels to specified areas, restrictions on the mode of propulsion used, limitations on maximum engine power or speed, prohibitions on recreational towing activities (e.g., water-skiing), and specify areas in which a permit is required in order to hold a sporting or recreational event.
The proposed regulations were published in the Canada Gazette on August 18, and are subject to a 60-day comment period. Based on feedback received during the comment period, a final draft will be pubiished later.

Former Chief Engineer Sentenced For Oil Discharge, Falsifying Logs |

A former Chief Engineer of the M/V Fidelio was arraigned in Federal Court in Maryland for illegally discharging waste oil through a 'magic pipe'which bypassed the ship's oily waste separator. Patrick Brown is also accused falsifying the ship's records to conceal illegal discharges. Brown faces a five-year prison term, fines, a special assessment and probation if found guilty.

Customs Announces New Manifest Rules |

US Customs and Border Protection has announced final rules for the transmission of electronic manifests for passengers, crew and supernumeraries on-board vessels arriving in and departing from the United States. For departing ships, passenger manifests must be transmitted no later than 60 minutes prior to departure. Arriving ships must deliver a passenger and crew manifest between 24 and 96 hours prior to arrival. Changes will take effect in February, 2008.

Oil Spill Protection Act Must Be Followed While Law Is Challenged |

The State of Massachusetts has determined that shippers and tugboat escorts must follow the State's Oil Spill Prevention Act while the law is challenged in court. Most of the law was ruled unconstitutional in 2006. It was enacted after a barge dumped nearly 100,000 gallons of oil into Buzzards Bay when one of the barge's tank's ruptured. The spill damaged more than 100 miles of shoreline, killed wildlife and halted operations on 90,000 acres of shellfish beds for moths after the spill.
